When should I fill in an application for seeking damages?
You can seek damages from the City of Kajaani to cover the costs of an accident in accordance with the Tort Liability Act (31.5.1974/412) if the accident occurred in an area managed by the City and there are reasonable grounds to believe that the City is party to the accident, for example, through significant maintenance neglect.
If the case involves damage to property, you can claim for damages from your own insurance company. If the accident happened at work or during a commute, you can claim for damages from your employer’s accident insurance.
What should an application for seeking damages include?
A claim for damages is made in writing and should provide the following information:
- What, where and when the accident happened
- The resulting injuries and/or damage and/or loss
- The grounds for liability (such as the poor condition of the road)
- Claim (expenses incurred, temporary harm/damage, etc.)
- Witnesses’ contact details
- The applicant’s contact details (including bank account number)
Attached to the claim for damages should be:
- The original paid invoices
- Medical certificate
- A map illustrating the scene of the accident
- Photograph(s)
- Police record of the investigation
- Any other material relating to the claim for damages
